1. Acceptance of terms
By accessing or using SmarterATS, you agree to be bound by these Terms of Service. If you do not agree, please do not use the platform.
2. The service
SmarterATS provides an AI-assisted applicant tracking and hiring platform, including sourcing, screening, interviewing, and analytics features delivered through our "Boo" agents, made available on a pay-as-you-go, coin-based basis.
3. Accounts and responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account, and for ensuring you have the right to upload any candidate data you submit.
4. Coins and payment
Access to certain AI-powered actions requires coins, purchased in advance. Coins are non-refundable except where required by law, and pricing may be updated with reasonable notice.
5. Acceptable use
You agree not to use SmarterATS for any unlawful purpose, to discriminate against candidates on the basis of protected characteristics, or to attempt to reverse-engineer or misuse Boo's underlying AI models.
6. Intellectual property
SmarterATS retains all rights, title, and interest in the platform, the Boo agents, and associated branding. Customers retain ownership of their own candidate and company data.
7. Limitation of liability
SmarterATS is provided "as is". To the maximum extent permitted by law, SmarterATS is not liable for indirect or consequential damages arising from use of the platform. AI recommendations are decision support only and require human review.
8. Changes to these terms
We may update these Terms from time to time. Continued use of SmarterATS after changes take effect constitutes acceptance of the updated Terms.
9. Governing law
These Terms are governed by applicable European Union and local law based on the jurisdiction of the contracting SmarterATS entity.
